Dutch Provinces Drop Legal Challenges Against Ineos Ethane Cracker in Antwerp

Zeeland and Noord-Brabant Provinces cease appeals against permits for Ineos's Project One, paving the way for continued development.
In a significant development for the chemical industry in Belgium, the Dutch provinces of Zeeland and Noord-Brabant have officially decided to discontinue their legal challenges against the environmental permits issued to Ineos for the ethane cracker project at the Port of Antwerp.

This decision was announced by the office of Flemish Prime Minister Matthias Diependaele, marking an important advancement for Project One, which aims to enhance ethylene production in the region.

The controversy surrounding the ethane cracker dates back to 2022 when the Flemish government granted Ineos an environmental permit following a lengthy approval process.

The provinces of Noord-Brabant and Zeeland contested this decision due to concerns about the environmental implications, particularly regarding nitrogen emissions and ecological impacts.

The Council for Permit Disputes annulled the initial permit in July 2023, leading to a series of conditional and definitive permits from Antwerp province, which were subsequently appealed.

In late 2023, discussions took place between Flemish and Dutch authorities, resulting in an agreement to suspend further legal proceedings while additional information regarding nitrogen deposition was sought.

The Flemish government emphasized its commitment to fostering consultation with the Netherlands in the years to come.

Prime Minister Diependaele stated, “Now that we have found each other, we will not let each other go.

In the coming months and years, we will continue to focus on even better relations with the Netherlands and its provinces.” The intention is to better coordinate the nitrogen and permit policies between Flemish and Dutch administrations, with a Flemish-Dutch summit scheduled for April 1, 2024, to further these discussions.

Minister of the Environment Jo Brouns described the cessation of legal appeals as a crucial step towards establishing a comprehensive licensing policy that benefits both the Flemish and Dutch economies.

Ports Minister Annick De Ridder expressed optimism that Ineos would be able to proceed with Project One unimpeded, describing it as one of the largest investments in the Flemish economy in decades, crucial for solidifying Antwerp's status as a key industrial hub.

The provinces of Noord-Brabant and Zeeland have affirmed their commitment to joint action in addressing cross-border environmental issues.

Noord-Brabant’s deputy Saskia Boelema highlighted that constructive consultations led to the conclusion that the increased emissions from Ineos would have acceptable effects on the Brabantse Wal area.

Zeeland's deputy for Nature, Wilfried Nielen, underscored the importance of systematic knowledge exchange and agreements on assessing cross-border environmental impacts for future developments.

Project One is a multi-billion dollar investment project initiated by Ineos, aiming to construct a large ethane cracker in Antwerp.

Announced in 2019, the facility is expected to bolster ethylene production, thereby reinforcing Antwerp's position as a central location for the plastics and chemicals manufacturing industry.

Despite facing significant opposition from environmental groups and local Dutch governments, which raised concerns about nitrogen and ecological damage, the project is now poised to advance following the resolution of legal disputes.
